Judgement of the Grand Chamber of the Court of Justice of the European Union, 1 October 2019, and Guidance on the use of cookies by the AEPD, July 2020.
The Judgement of the Grand Chamber of the Court of Justice of the European Union of 1 October 2019 must be interpreted as meaning that consent is not validly given when information storage, or access to information already stored in the terminal equipment of the user of an internet website is authorised through the use of cookies by means of a checkbox ticked by default - a tick which the user must remove the tick if they want to refuse their use. In this sense, the authorisation must be based on an explicit consent by means of an explicit acceptance check, a refusal check by the user, and a check for more information on the cookies exposed.
This interpretation cannot vary depending on whether or not the information stored or consulted on the user's terminal of an Internet site consists of personal data.
The Grand Chamber of the Court of Justice of the European Union also states in this ruling that the information provided by the service provider to the user of an Internet website must include the time that the cookies will remain active and the possibility that third parties can access the information stored in them. This requirement is set out in the version amended by Directive 2009/136, amending Article 5(3) of Directive 2002/58/EU, and by the AEPD Guidance of July 2020
